First important point: Rule #1 with judges is they hate to see a party not go through CBA-mandated arbitration. The CBA provides that this stuff first goes to arbitration (before heading to court). Judges want parties see arbitration all the way through to its logical end and be active participants in it. If a party like A-Rod doesnt do that, and the case heads to court, a judge can get real cranky in a hurry. So its best not to storm out and never come back. By failing to attend the rest of the arbitration, A-Rod may effectively be undermining the strength of his court case. Now on to Bud Selig. A-Rod was really upset over the arbitrator Horowitz agreeing with MLB that Selig didnt need to testify. The decision not to have Selig testify was probablly the right one. Per Mertesacker Arsenal Jersey. When determining whether someone should testify, you consider the relevance and utility of the testimony. Yes, Selig is the boss. However, he didnt do the heavy lifting. Others reported to him and his testimony would have offered very little when it comes to assessing the facts and merits of the case. MLB COO Rob Manfred (whos the frontrunner to be the next Commissioner by the way) did testify and was the subject of an extensive cross-examination by A-Rods lawyers. Manfred is a key figure in these proceedings and his testimony is relevant and important; however, Seligs is not for the purpose of the arbitration hearing. Horowitz probably concluded that Selig couldnt add anything. It will be a different story if the court case gets any serious traction. In court, expect A-Rod to call everyone under the sun from Selig to Youpi. So whats next. It would be a surprise to see A-Rods legal team completely abandon the hearing. Whether they do or not, the arbitrator Horowitz will still make his decision based upon the merits of the case. If MLBs allegations go unchallenged, then the arbitrator may declare the allegations to be true. As well, electing not to return would undermine the court case. So from the standpoint of the litigation matter as a whole, its in the best interest of A-Rods legal team to return to arbitration so expect them to head back. This case is far from done. There is still a lot of legal wrangling ahead with no end in sight. Coming after a pre-season that saw him pitch just three innings as he protected his shoulder, it all means that Janssen is a long way off from where he hoped to be. "Im starting to trust it a lot more," he said of the problem oblique muscle. "Im starting to be a lot more active on it. The recovery is quicker, I guess. If Im active on it, within a few hours it (the discomfort) is probably gone. You wake up with a fresh start every day which is nice. "Ive just got to continue to progress. The further we get away from that Montreal date, the healthier its going to get." The Montreal date was the late March finale to the Toronto pre-season. Janssen felt something as he was warming up to go in against the New York Mets, but didnt think it was anything more than a "tight something." "Never did I imagine Id be sitting here in late April having not thrown a pitch," he said. The days after, however, he knew it was something more than tightness. Janssen is slated to throw a bullpen session Sunday, with another planned a few days later. A rehab assignment in the minors will follow. He has already had one of those shut down mid-month when it was determined he needed further rest. "I cant wait to throw (the bullpen session), Im excited," he said. "Hopefully theres no looking back." As frustrated as he is by the inactivity, the 32-year-old right-hander understands patience is needed. "Being in the position where I pitch in a game, youve got to be good," he said. "You dont want to let the team down by figuring it out up here. "So I want to be clicking once I get up here ... At the end of the day, my arms got to be able to bounce back, do the things Im asked to do here and then also have my side tested enough where, the same thing, Im not getting special treatment when Im ready." Janssen, who converted 34-of-36 save opportunities last season. says he only feels the injury occasionally in his day-to-day life. But given the importance of the bodys trunk to throwing, it is like Kryptonite to a pitcher. "Theres no injury thats fun," he said. "This one seems to take lot more time, even when theres no extreme pain." Sergio Santos has assumed the role of closer in Janssens absence. Despite Sullivans positive take, Vancouver is now just 2 for 30 with the man advantage over its last eight games. "We had good chances, good looks. I thought we moved the puck well," said Daniel Sedin, who has now gone 11 games without scoring. "In the end it doesnt really matter right now. Weve got to get some goals. "Its up to us in here to make it happen. No excuses." Craig Smith had the other goal for Nashville (23-22-7), while Carter Hutton made 32 saves as the Predators picked up their fourth victory in the last five outings. Spaling also had an assist. "We got some good goaltending, Carter was really good on those backdoor plays," said Predators coach Barry Trotz, whose team improved to 1-21-2 when trailing after two periods. "They were executing that pretty well. We were having trouble trying to stop that and he got over there a couple times. "It was a good character test. "Going into the third when youve got a lead the least you can do is bring it to overtime. Its disappointing," said Luongo. "I need to make a better play on the first one, be more patient on the wrap and read that play a bit better." The Predators kept pushing as the period wore on, with their sixth-ranked power play getting a couple of chances. The Canucks penalty kill -- which sits second in the NHL this season -- held firm until Seth Jones connected with Spaling at 12:38. Jones fired a shot from the point that Spaling tipped past Luongo with just three seconds left on the Nashville man advantage to give the Predators their first lead. Vancouver had another power-play chance late, but couldnt find a way past Hutton. "The NHL is about a lot of low scoring games," said Luongo. "Weve got to find ways to win them. Weve got to find ways to bring these games to overtime. Weve got to find ways to protect leads. When we get scored on weve got to keep playing. "Its a tough one to lose going into the third with the lead." After a scoreless first period, Higgins broke the deadlock at 9:09 of the second with his 13th of the season on a nifty deflection. Canucks forward Dale Weise floated a shot towards the Nashville net that Higgins tipped up and over a helpless Hutton for his first goal in seven games. All 13 of Higgins goals have come at even strength and Thursdays effort was just Vancouvers sixth overall in the last six contests. The Canucks power play continued to miss the mark in the second, with defenceman Jason Garrison blasting a shot from the point midway though the period that Hutton handled. "I thought this particular game, the power play had better puck movement and even though we didnt score we got some momentum off of it because at least they had some looks and they had some opportunities, which for me is progress in the right direction," said Sullivan. "The next step is we have to finish. We have to put it in the net." The Canucks were again without head coach John Tortorella, who served the second game of his 15-day suspension for attempting to get into the Calgary Flames locker-room after Saturdays line brawl. Vancouver was also missing captain Henrik Sedin and fellow forward Mike Santorelli. Thought to be nursing rib and finger injuries, Sedin saw his iron man streak of 679 straight games come to an end when he sat out Tuesdays 2-1 road victory over the Edmonton Oilers. Santorelli, meanwhile, missed his third in a row, also with an upper-body injury. Despite their recent run of good form, the Predators still sit eight points back of the final wild card spot in the conference behind the Canucks and Minnesota Wild. "This team has been really resilient all year," said Trotz. "Its been a little bit of an uphill battle all year. This team has got a lot of backbone, a lot of character and this group cares about each other so when things are a little bit rough they dig in and thats a great quality to have."
