Alex Rodriguez got so upset at Wednesdays arbitration hearing, he kicked his briefcase and stormed out. Jake Butt Jersey . After the incident, he went on Mike Francesas radio show on WFAN and referred to the arbitration process as "kangaroo court" and "disgusting". He then declared this about his prospects of success: "Im done. I dont have a chance. You let the arbiter decide whatever he decides." According to A-Rod, the trigger for all this was the arbitrator, Fredric Horowitz ruling that MLB Commissioner Bud Selig didnt need to testify at the hearing. Selig, according to A-Rod, is "trying to destroy me... put me on his big mantle" as a "helluva trophy". So what does all this mean? Where is this headed? First important point: Rule #1 with judges is they hate to see a party not go through CBA-mandated arbitration. The CBA provides that this stuff first goes to arbitration (before heading to court). Judges want parties see arbitration all the way through to its logical end and be active participants in it. If a party like A-Rod doesnt do that, and the case heads to court, a judge can get real cranky in a hurry. So its best not to storm out and never come back. By failing to attend the rest of the arbitration, A-Rod may effectively be undermining the strength of his court case. Now on to Bud Selig. A-Rod was really upset over the arbitrator Horowitz agreeing with MLB that Selig didnt need to testify. The decision not to have Selig testify was probably the right one. When determining whether someone should testify, you consider the relevance and utility of the testimony. Yes, Selig is the boss. However, he didnt do the heavy lifting. Others reported to him and his testimony would have offered very little when it comes to assessing the facts and merits of the case. MLB COO Rob Manfred (whos the frontrunner to be the next Commissioner by the way) did testify and was the subject of an extensive cross-examination by A-Rods lawyers. Manfred is a key figure in these proceedings and his testimony is relevant and important; however, Seligs is not for the purpose of the arbitration hearing. Horowitz probably concluded that Selig couldnt add anything. It will be a different story if the court case gets any serious traction. In court, expect A-Rod to call everyone under the sun from Selig to Youpi. So whats next. It would be a surprise to see A-Rods legal team completely abandon the hearing. Whether they do or not, the arbitrator Horowitz will still make his decision based upon the merits of the case. If MLBs allegations go unchallenged, then the arbitrator may declare the allegations to be true. As well, electing not to return would undermine the court case. So from the standpoint of the litigation matter as a whole, its in the best interest of A-Rods legal team to return to arbitration so expect them to head back. This case is far from done. There is still a lot of legal wrangling ahead with no end in sight. Guenette matched his career-best finish, set the first time in this event a year ago, and matched earlier this year at Circuit ICAR. "I pushed real hard to try to pass Scott [Steckly], but I finished second to him again this year," Guenette said. "Hopefully, soon enough we will be able to pull a win." With a fourth consecutive podium finish, Dumoulin extended his advantage in the season points standings to 251-234 on Fitzpatrick. "Its awesome for us," Dumoulin said of his third place finish after the team struggled a bit earlier in the day. "Weve had a really good season so far and we want to keep it that way." The Formations After losing 1-0 to the Los Angeles Galaxy in Carson, California, last weekend, Vancouver Whitecaps head coach Carl Robinson chose a different tactical formation for the rematch at BC Place. The Game The Galaxy have for many years been the standard by which every team in MLS is judged. They are well organized, tactically disciplined and, in Robbie Keane and Landon Donovan, have two of the most dynamic attacking players in the league. Bruce Arena is arguably the best coach in MLS and he showed his pedigree with his game plan against Vancouver. The Galaxy encouraged the Whitecaps to have the ball at the back, and as soon as either of Vancouvers central defenders - Jay DeMerit of Andy OBrien - had the ball, LA applied immediate pressure. This disrupted the Whitecaps, as they werent able to effectively move the ball out of the back. When the Galaxy were in possession, both Keane and Donovan dropped into midfield when the opportunity arose. This encouraged Baggio Husidic, Stefan Ishizaki and Marcelo Sarvas to make penetrating runs from midfield, which caused Vancouver problems defensively. Far too often, Russell Teibert and Gershon Koffie were narrow defensively, leaving too much space for the Galaxy to exploit in wide areas. This was the case when the Galaxy opened the scoring in the first half. Matias Laba vacated his central position to put pressure on Galaxy fullback, Dan Gargan, who had acres of space on the right flank to deliver a cross to the back post. Labas enthusiasm meant the Whitecaps had no midfield presence in the penalty area to deal with Ishizaki or Donovan, who had drifted into midfield. The lack of midfield defensive cover meant that the Whitecaps were outnumbered in their own penalty area when the ball was delivered. Defensively, the back four were culpable for not dealing with the cross from Gargan, as well as for not marking effectively in the penalty area. When Husidic headed the ball back across goal, every Whitecaps defender got caught ball watching, with Ishizaki lurking near the penalty spot. Given that Laba was out of position on the left - and no other midfielder slid in to cover his defensive responsibilities, Ishizaki was left with a free header from six yards out to open the scoring. Worryingly for Vancouver, Donovan was also in a prime scoring position, completely unmarked. A series of defensive mistakes that individually, might not prove costly. But collectively, these mistakes lead to goals being conceded. At the halftime break, Robinson made a bold move - which proved to be the correct one - by making two substitutions. Jonny Leveron and Kekuta Manneh came into the match, replacing Andy OBrien and Russell Teibert. Leveron immediately improved Vancouvers ability to move the ball out of the back and into midfield, and Manneh provided an attacking threat that was missing in the first half. This threat was further amplified when Erik Hurtado replaced the largely ineffective Pedro Morales part way through the second half. Both Manneh and Hurtado stretched the Galaxy back line with their speed and direct play. It was Hurtados forward run that played a role in Darren Mattocks equalizer, and after Robbie Keane had put the Galaxy back in front, it was Manneh who drove home Vancouvers second tying goal. The Whitecaps deserve credit for building a squad of players rather than just focusing on improving their starting eleven. In every game this season, Vancouver have had options on the bench that could change the game, and Saturdays game was an example of how Robinson used those options effectively. There will be many fans calling for Manneh - who was Player of the Match in my eyes for his 45-minute performance - to get a run of games in the starting lineup now. But those fans need to be careful what they wish for. The biggest challenge that all young players face is finding a level of consistency from game to game. Manneh faces this same challenge, and despite his bright performance against the Galaxy (as well as a good performance as a substitute against Chivas USA in the second week of the season), I feel that Robinson is doing the right thing by keeping the reins on Manneh as a first team regular. It is far better to have a player succeed in the long-term, rather than to have him fizzle out because he was rushed into the first team. The Positives One of the criticisms levied against former head coach Martin Rennie was that he could be indecisive. Many felt that Rennie waited too long in games to make his substitutions, thus reducing the impact of the players he brought on to change the game. This criticism cannot be levied against Robinson. The first-year coach made a bold move taking off OBrien and Teibert at the half. Robinson also altered Vancouvers tactical approach during the second half, changing their 4-4-2 midfield diamond to a more conventional 4-4-2, with the central midfielders operating as double pivots. "Sometimes, you have to put your future in the hands of nature and God," McClain said. "Playing again was something I just needed to do in time. I was focused on coming right back. LOS ANGELES -- A trial will be held next month to determine whether Donald Sterling, who opposes his estranged wifes planned sale of the Los Angeles Clippers, was properly removed as an administrator for the family trust that owns the team. A probate court judge in Los Angeles Wednesday denied Shelly Sterlings urgent request to confirm her authority as sole administrator of The Sterling Family Trust so that she can unilaterally proceed with a $2 billion sale of the team to former Microsoft CEO Steve Ballmer. Instead, the judge agreed to an expedited hearing because of looming sales deadlines. The development is the latest in a legal tug-of-war following the NBAs decision to ban Donald Sterling for life after racist remarks to a girlfriend were recorded and publicized. Donald Sterling is fighting the decision and suing the league for $1 billion. The league has contended the comments were bad for business and damaged both the Clippers and the NBA. The four-day trial was granted exceptionally quickly and will begin July 7. The deadline for the sale is July 15, which also is the date the NBAs owners hope to vote on whether they will approve the sale. Court filings Wednesday indicated the NBA has set a hard deadline of Sept. 15. If the sale isnt completed then, the league will undertake proceedings to seize and sell the team on its own. Donald Sterlings lawyer, Bobby Samini, left the courthouse without comment after a clerk announced the trial schedule. Neither Sterling was present. "I just want to resolve this as quickly as possible," NBA Commissioner Adam Silver told The Associated Press on Wednesday in Miami at an NBA Cares event. The crux of the case will centre on the question of whether the 80-year-old Donald Sterling is mentally competent to be a co-trustee of The Sterling Family Trust, which gives him the authority to determine the teams future. According to the trusts terms, he can be ruled "mentally incapacitated" after being evaluated by two doctors, said Pierce ODonnell, Shelly Sterlings attorney. Shelly Sterling activated that clause in negotiating what would be a record-breaking deal with Ballmer as sole trustee. But Donald Sterling challenged the removal in a letter sent Monday to his wifes attorney said "any attempt to remove me as a Trustee of the Sterling Trust is invalid and illegal. Furthermore, any assertion that I am incapacitated... is false and without merit." According to court documents, two doctors examined Donald Sterling in May and concluded that he suffers from "mild cognitive impairment consistent with early Alzheimers Disease" or some other forms of brain disease after examining brain scans and having him undergo other tests. "In my opinion he is substantially unable to manage his finances and resist fraud and undue influence, and is no longer competent to act as trustee of his trust," concluded Dr. James E. Spar, who is affiliated with the division of geriatric psychiatry at UCLA. Sterling voluntarily went to the doctors at the request of his wife, according to a person with knowledge of the proceedings who spoke on condition of anonymity because they were not authorized to discuss the details publicly. A third doctor reviewed the two doctors findings as well as Sterlings brain scans and concurred with their conclusions that he "lacks the capacity to function as trustee." Donald Sterlings attorney, Maxwell Blecher, contested the doctors findings in remarks Tuesday to The Associated Press. "Anybody at his age level on a brain scan would probably show some impairment. But that doesnt mean you forget where your car keys are and youre incompetent," Blecher said. "There isnt the slightest evidence hes incapable of managing his affairs." Donald Sterling said in a statement that hes not just fighting for the Clippers but taking a stand against the NBA, which he called "a band of hypocrites and bullies" and "despicable monsters" who want "to take away our privacy rights and freedom of speech." "As Ive said previously, if Donald chooses to litigate against us, so be it," Silver said. "So its going to take longer than we had hoped for this transaction to close, but itll get done ultimately. Its just a question of time." Ballmers attorney, Adam Streisand, said he was pleased with the trial schedule and "confident that after the trial the court is going to bless this transaction." The NBAs general counsel, Rick Buchanan, warned in a court papers that if the judge didnt confirm Shelly Sterlings sole trusteeship and if her deal with Ballmer "is not promptly consummated, there will be substantial harm" to the Clippers, the NBA and even The Sterling Family Trust -- the last of which would be responsible for the NBAs costs related to the legal proceedings that result. Buchanan said a recent independent survey of more than 500 Clippers fans found the majority would be less likely to support the team if Donald Sterling remained its owner. Buchanan said thousands of NBA fans worldwide have contacted the league directly or via social media to say theyre hurt or embarrassed by his views and arent sure theyll continue supporting the league and its teams. He also cited NBA player worries about the impact for the team with the upcoming NBA draft. "Mr. Sterlings continued ownership is damaging the Clippers and NBAs relationships with existing and potential business partners and licenses," Buchanan wrote. He said nearly all of the Clippers local sponsors have terminated or suspended their relationships with the team, including Adidas, Commerce Casino and Hotel, Red Bull, Mandalay Bay Hotel, Virgin America and Mercedes.
