SAN FRANCISCO - A woman alleges former San Francisco 49ers defensive lineman Ray McDonald sexually assaulted her after a night of drinking and after she injured her head in a fall by his swimming pool, according to court documents unsealed Monday. McDonald also told police the entire incident was captured on his internal video system and was on his DVR in his room.No charged have been filed, and the San Jose police continue to investigate. McDonald could not be reached for comment, and his agent, Tom Condon, didnt immediately respond to text and phone messages.The court documents were written by San Jose police investigators to obtain a search warrant for McDonalds home.The documents were unsealed in Santa Clara County Superior Court and stated that the incident began with the woman drinking with friends at their home. They then met McDonald and several of his friends at a nearby bar and finished the night at his San Jose home.She told police the last thing she remembers about the evening is falling down near McDonalds pool and hurting her head. She awoke naked the next morning next to McDonald, who initially denied a sexual encounter, according to the court documents.The woman stayed with McDonald at his home the next day and drank vodka with McDonald and San Francisco 49ers player Aldon Smith, according to the papers. Thats when McDonald conceded that a sexual encounter occurred, according to the court documents.An investigator using the womans phone Dec. 16 and pretending to be her texted McDonald complaining about the encounter. McDonald responded by saying the woman started coming on to me and that the incident was consensual.I dont understand why youre bothered. U chose to stay with me another day, McDonald texted. The investigator posing as the woman replied that McDonald shouldnt have had sex with her while she was unconscious.I didnt do anything wrong, McDonald replied. His home was searched that night.The affidavit submitted by San Jose police to a judge in application for a search warrant said the sexual encountered occurred on Dec. 13 and that Smith had drinks with the pair Dec. 14. More importantly, now, they are tied with the Boston Red Sox for third in the American League East, just a game-and-a half back of the first-place Baltimore Orioles. Not only that, they have the top-ranked hitting team in the American League with a .255 average , 56 homers and a league-leading 207 runs scored and the top OPS of .762. Theyve improved by leaps and bounds in the fielding department, as well. Theyve committed only 20 errors in 42 games, second fewest to only Baltimores 19 in the American League. There are still a few red flags, though. The Blue Jays team ERA is 4.56, ranked 11th in the American League and worst in their own division. With the problems at the back end of the rotation - Brandon Morrow (DL now), J.A Happ ( struggling until Thursday night) and Dustin McGowan (moved to the bullpen on Thursday) - the Jays have still managed 19 quality starts in 42 games. Thats tied with the Yankees for second in their division behind Bostons 27. Tampa Bay has 14 quality starts, largely because three of their starting pitchers have been injured, and Baltimore is somehow leading the division with only 13 quality starts. Another thing that should be of concern is who the Jays have been beating. They are a combined 10-3 against the Philadelphia Phillies, Cleveland Indians and Houston Astros, teams that have a combined record of 50-70. The Jays are 11-18 against all the rest. Remember, too, over their final 120 games, exactly half are against their own division. Then you have seven against the AL West-leading Oakland Athletics, six against the AL Central-leading Detroit Tigers and 13 Interleague games including four with the NL Central-leading Milwaukee Brewers, three with the St. Louis Cardinals, three with the Cincinnati Reds and a bit of a respite in September with three at home against the Cubs. The two biggest question marks are how they sort out those four and five slots in their rotation and whether they can start playing better against the teams in their own division with regularity the rest of the way. He was almost considered a throw-in in the massive deal with the Blue Jays two years ago, that brought Mark Buehrle, Jose Reyes and others to the Jays. DeSclafani didnt disappoint in his debut. He pitched six solid innings, striking out seven in a 13-3 blowout of the Dodgers. He not only got his first Major League win, but he stroked a two-run single for his first Major League hit. The funny thing about the hit is, its one more than the entire Marlins pitching staff had through that night. The Marlins pitchers were a collective 0 for 64. The one mild surprise may be that DeSclafani made it to the Majors before his minor=league teammate lefty Justin Nicolino, who also came over in that trade with the Blue Jays. - Joel Sherman of the New York Post mentioned the other day that the Mets should deal from strength and package a couple of their young arms for a much needed bat and suggested they go after the Blue Jays Jose Bautista or Chicago White Sox shortstop Alexei Ramirez. The Mets called up two of those dynamite young arms this week in Rafael Montero and Jake deGrom, who went a combined 13 innings and gave up only four runs total. Still, the Mets lost both games at Citi Field, 3-0 Wednesday and 1-0 Thursday. The Mets, though they are 19-21, are still just two games out of a wild card spot in the National League. The pressure is on them to finally make it back to the post-season. They should be an interesting team to watch as the trade season approaches in late June and then on into July. - Bad break for former Blue Jays catching prospect Travis DArnaud, who went over to the Mets as part of the R.A. Neal, 26, is a power forward who has been riding high while playing on Evgeni Malkins wing for the bulk of his time in Pittsburgh. Over the past three seasons, he has scored 88 goals, which ranks fifth, behind Alex Ovechkin, Steven Stamkos, Corey Perry and Phil Kessel. Hes also put up dominant possession stats, but a lot of that would figure to be related to the favourable ice time that he gets with Malkin. While the Predators are aiming to get more scoring in their game, they dont nearly have the playmakers to compare with Pittsburgh, so if Neal ends up playing with Mike Fisher, Colin Wilson or Calle Jarnkrok, none of them is particularly dominant offensively, so expect Neals production to dip. The question is, how far? Before he joined the Penguins, Neal had 131 points in 214 games with the Dallas Stars, a 50-point pace over an 82-game season. That should be about the baseline, with room to move up because Neal currently is a better player than he was from age 21 to 23, but we can also keep in mind that Neal has scored more than 60 points twice in his career. Neal is signed for four more years, at a cap hit of $5-million per season, so hes a reasonably-priced first line forward for the Predators. The Penguins Get: RW Patric Hornqvist and LW Nick Spaling. Hornqvist is a 27-year-old winger who has been one of the more prolific shooters in the game over the past five seasons. Hes a four-time 20-goal scorer who is most effective right around the crease, deflecting shots and knocking in rebounds. He played primarily with Mike Fisher last season (with Colin Wilson and Matt Cullen their most common linemates) and while that line was effective -- Hornqvists relative possession stats have always been really good -- its not quite as dynamic as what opportunities Hornqvist should have in Pittsburgh. If Neal is expected to see his scoring go down as a result of this trade, naturally Hornqvist should expect an uptick in his scoring numbers. He scored a career-high 53 points last season and while his on-ice shooting percentage was a career-best, it wasnt outrageous and is still below what is typical for wingers alongside Malkin or Crosby. Signed for four more years, at a cap hit of $4.25-million, Hornqvist comes a little cheaper than Neal, but not dramatically, so the Penguins have to expect that they are not going to lose much offensively. Spaling, 25, scored a career-best 32 points last season, playing a career-high 16:01 per game, and while he may not play quite as much in Pittsburgh, the hope is that he might help the Penguins bottom six forwards. However, Spalings possession stats have been rough for most of his time in Nashville, which doesnt suggest that hell be turning the tide on his own. A restricted free agent who earned $1.5-million last season, Spaling is looking at a raise, but the Penguins are probably not in position to give him a lot more money, but they need Spaling to give them more reliable minutes on the third line. It didnt come as a massive surprise that the Penguins moved Neal -- it has been rumoured as a possibility for some time -- but the return may be something of a surprise. The Penguins didnt save a bunch of money; rather, they found a couple of forwards with the hope that will help improve their depth up front. They sacrificed the most talented player in the deal, though, and that presents a certain amount of risk, particularly if Hornqvist doesnt produce at the same level. For a Nashville team that is making a concerted effort towards a more offensive style, Neal is a big addition, well worth the price they paid.
